Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Unscripted Technology LLC, an Oregon limited liability company (Oregon Secretary of State Registry Number 258003293) with its principal office at 9233 SE Harney Court, Portland, Oregon 97266 ("Company," "we," "us," or "our"), regarding your use of the Unscripted mobile application and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To use Unscripted, you must:

• Be at least 18 years of age
• Be legally authorized to enter into this agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned or suspended from the Service
• Use the Service for personal, non-commercial purposes only

By creating an account, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you may not use the Service.

3. Account Creation and Security

3.1 Account Registration

• You must provide accurate, complete, and current information during registration
• You must maintain and promptly update your account information
• You may only create one account per person
• You may not impersonate another person or use someone else's identity

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach
• We are not liable for any loss or damage arising from your failure to maintain account security

3.3 Account Verification Charge

To confirm you are a real person and to deter bots and fake profiles, we may require a one-time, non-refundable charge of US $1.00 to a valid payment card you own. This charge is processed by our payment processor, Stripe; your card is tokenized by Stripe and we never receive or store your full card number. Because the charge is the cost of verification — not a purchase of goods or services — it is non-refundable, and we disclose it to you before you authorize payment. The charge is not required to browse, and we will tell you in the app before any amount is charged.

4. User Conduct and Content

4.1 Acceptable Use

You agree to use the Service in accordance with these Terms and all applicable laws. You agree NOT to:

• Harass, threaten, intimidate, or harm other users
• Post violent, graphic, obscene, or sexually explicit content
• Use the Service for commercial purposes or advertising
• Spam, solicit money, or scam other users
• Share contact information in your profile (email, phone, social media) before matching
• Promote illegal activities or substances
• Impersonate others or provide false information
• Use automated systems, bots, or scripts to access the Service
• Attempt to access other users' accounts or private information
• Reverse engineer, decompile, or modify the app
• Collect or harvest user data for any purpose
• Interfere with the Service's operation or security

4.2 Content Ownership and License

• You retain ownership of all content you post (photos, bio, messages)
• By posting content, you grant Unscripted a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the Service
• This license continues for a commercially reasonable period after you delete your account to allow for cached or backup content
• You represent that you have all necessary rights to grant this license

4.3 Content Standards

• Profile photos must clearly show your face
• Photos must be of you (no group photos as primary, no children, no celebrities)
• Photos must be appropriate and not contain nudity or sexually suggestive content
• Bio content must be truthful and not contain offensive language
• Messages must be respectful and appropriate

5. Content Moderation and Removal

Unscripted reserves the right, but has no obligation, to:

• Monitor user content and conduct
• Remove content that violates these Terms
• Suspend or terminate accounts that violate these Terms
• Report illegal activity to law enforcement

We may remove content or suspend accounts without prior notice if we believe, in our sole discretion, that they violate these Terms or applicable laws.

6. Reporting and Safety

6.1 Reporting Users

If you encounter inappropriate behavior or content, you can report users through the app. Report categories include:

• Inappropriate content
• Harassment or bullying
• Fake profile or spam
• Safety concern
• Underage user
• Other violations

6.2 Blocking Users

• You can block users to prevent them from contacting you or viewing your profile
• Blocked users will not be notified of the block
• Blocking is permanent and cannot be undone

6.3 Our Investigation Process

• We investigate all reports of Terms violations
• Users may be warned, suspended, or permanently banned based on severity
• We may request additional information during investigations
• Our decisions regarding account status are final

§A. TAKE IT DOWN Act Compliance (NCII Removal)

Under 15 U.S.C. §6851 et seq., Unscripted accepts requests from individuals depicted in non-consensual intimate imagery, or their legal representatives, for the removal of such imagery from our platform. We will remove qualifying material — and make reasonable efforts to remove identical copies — within 48 hours of receiving a valid request. Submit requests to takedown@unscripteddating.app or via the in-app Report Content form (Settings → Safety & Reporting).

§C. DMCA Designated Agent (17 U.S.C. §512(c)(2))

Our Designated Agent is registered with the U.S. Copyright Office (Registration Number DMCA-1073411) and is listed in the public DMCA Designated Agent Directory at https://www.copyright.gov/dmca-directory/. A valid §512(c)(3) notification must include: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it; (d) the complainant's contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and the complainant is authorized to act on behalf of the owner.

§D. California Age-Appropriate Design Code (Neutral Age Gate)

Unscripted is an adults-only service. We require all users to be 18 or older at registration. We do not present the age gate in a manner designed to encourage minors to misrepresent their age, and we do not knowingly direct services to children under 18. This commitment is consistent with the California Age-Appropriate Design Code Act, Cal. Civ. Code §1798.99.31, the provisions of which became enforceable following the Ninth Circuit's mandate of 2026-04-03 partially vacating the prior preliminary injunction.

§E. FTC Endorsements and Testimonials

We do not solicit, post, or fabricate user testimonials or App Store reviews. All endorsements appearing in our marketing reflect actual user experience. This commitment is consistent with the FTC's Rule on the Use of Consumer Reviews and Testimonials, 16 C.F.R. Part 465 (effective 2024-10-21).

7. Account Suspension and Termination

7.1 Termination by You

• You may delete your account at any time through app settings
• Upon deletion, your profile, messages, and personal data will be removed
• Some information may be retained as required by law or for legitimate business purposes

7.2 Termination by Unscripted

We may suspend or terminate your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Repeated reports from other users
• Extended periods of inactivity
• Any conduct we deem harmful to the Service or other users

7.3 Effect of Termination

• Upon termination, your right to use the Service ceases immediately
• You may not create a new account without our permission
• Terminated accounts cannot be reactivated
• No refunds will be provided for terminated accounts

8. Intellectual Property Rights

8.1 Our Intellectual Property

The Service, including all content, features, functionality, software, and design, is owned by Unscripted and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Use our trademarks, logos, or branding without permission
• Remove or alter any copyright or proprietary notices
• Use our intellectual property for commercial purposes

8.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide license to use such feedback without compensation or attribution.

9. Third-Party Services

The Service may integrate with third-party services, including:

• Google AdMob: For displaying advertisements
• Cloudflare R2: For image storage
• Apple Services: For push notifications and app distribution
• Stripe: For processing the optional one-time $1.00 account-verification charge

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third parties.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any information provided through the Service is accurate or reliable
• Any defects will be corrected
• You will find compatible matches or relationships

10.2 User Interactions

• We do not conduct background checks on users
• We are not responsible for user conduct, whether online or offline
• You are solely responsible for your interactions with other users
• Always use caution when meeting people in person
• We recommend meeting in public places and informing friends or family

10.3 Limitation of Liability

11. Indemnification

You agree to indemnify, defend, and hold harmless Unscripted, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your content or conduct

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

12.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be seated in Multnomah County, Oregon, unless the parties agree otherwise, and judgment on the arbitration award may be entered in any court having jurisdiction.

Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or violations of computer fraud and abuse laws.

12.3 Class Action Waiver

12.4 Time Limit for Claims

Any claim related to the Service must be brought within one (1) year of the event giving rise to the claim, or such claim is permanently barred.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you through in-app notification or email
• Require your acceptance of the new Terms to continue using the Service

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unscripted regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and Unscripted as a result of these Terms or your use of the Service.

14.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
